Dear Participants of the Foundation,

Following the last two newsletters issued by the Foundation informing that Volkswagen is blocking a transparent revision of the facts and is still refusing to negotiate, the Foundation is now seeking clarification of the facts of the case through court. The Foundation remains open for discussion.

The Foundation filed a motion for discovery proceedings in the multidistrict litigation before Judge Breyer in San Francisco in accordance with section 1782 title 28 United States Code. The Foundation´s objective is to force Volkswagen to disclose evidence concerning the diesel emission scandal. We consider this procedure necessary for an effective litigation.

The motion was filed by a well-respected law firm in California, USA. A first result is expected by the end of October 2016.

Again we want to point out, that the extended deadline for the judicial assertion of claims by the well-respected German law firm Nieding + BarthRechtsanwaltsaktiengesellschaft (Nieding + Barth) is ending on September 15, 2016.

Furthermore a detailed information for Volkswagen bondholders will be issued soon. Concerning the bondholders, the Foundation plans the initiation of legal proceedings.
